The Conservation Commission has been undergoing a comprehensive review of their Rules and Regulations, and will be voting on the revisions at their upcoming public hearing on August 21, 2025. See below for more information. 

Wetlands Protection Rules & Regulations Update 

What does the Dedham Conservation Commission do?

The Dedham Conservation Commission is a seven-member volunteer board appointed by the Select Board. It administers both the Massachusetts Wetlands Protection Act (WPA) and Dedham’s local Wetlands Protection Bylaw and associated Rules & Regulations. The Commission also oversees over 12,000 acres of open space in town.

What are the Wetlands Protection Rules & Regulations?

The Wetlands Protection Rules & Regulations is a comprehensive document that outlines the procedural requirements and performance standards necessary to implement the provisions of the Wetlands Protection Bylaw effectively. The regulations serve as a detailed guide for applicants by clarifying the intent of the Bylaw and specifying how its components are to be interpreted and applied. The document includes guidance on filing applications, notifying abutters, permitting requirements, and mitigation measures to ensure effective wetlands protection within Dedham.

Why are the Wetlands Protection Rules & Regulations being updated?

Both the Wetlands Protection Bylaw and its accompanying Rules & Regulations had not been revised since 2003, resulting in outdated information, inconsistencies, and unclear procedures that often led to confusion among applicants and stakeholders. In 2024, Town Meeting approved an updated version of the Bylaw. In conjunction with that update, the Conservation Commission undertook a comprehensive review and revision of the Rules & Regulations to ensure consistency with the new Bylaw and to incorporate lessons learned since its original adoption. This effort draws upon current best practices in wetland protection, improved permitting processes, and input from applicants regarding areas of ambiguity or inefficiency.

How do the proposed updated Wetlands Protection Rules & Regulations get approved?

Unlike Bylaw amendments that require Town Meeting approval, updates to the Rules & Regulations are adopted by a majority vote of the Conservation Commission during a public hearing.

What has been the process to update these Rules & Regulations?

The Conservation Commission has been actively discussing the proposed updates since May 2024 through the course of 12 public hearings, with prior groundwork laid by former Conservation staff. Minutes from these hearings are available on the Conservation Commission website. The updates are informed by peer communities, stakeholder groups such as the Charles River Watershed Association, and reviewed by Dedham’s Town Counsel.

What are the proposed major updates?

  • Definitions: Add new definitions for clarity; removed redundant language duplicating the Wetlands Protection Act.
  • Climate Resilience: Incorporate standards recommended by regional and state organizations to address climate change impacts on wetlands.
  • Undisturbed Buffer Area: Clarify requirements and add a new appendix explaining calculation methods.
  • Fee Schedule: Increase filing fees to align with neighboring communities.
  • Vernal Pool Setbacks: Increase the required no-disturb zone from 75 feet to 100 feet to better protect biodiversity.
  • Performance Standards: New resource area standards now require projects to meet Wetland Protection Act baseline protections and demonstrate net ecological improvement.
  • Riverfront Redevelopment: Projects must meet state Riverfront Area standards and include a vegetated buffer strip to enhance habitat and water quality.
  • Trees: Codify the Dedham Conservation Commission’s Tree Replacement Policy. Based on feedback from the public, trees over 24” Diameter at Breast Height (DBH) will be considered “Significant Trees” and cannot be removed without a waiver from the Commission.
  • Waiver Criteria: Introduce a clearer, more detailed waiver process to replace vague current guidance.
